Israel has officially contested the International Criminal Court’s (ICC) jurisdiction regarding arrest warrants for Prime Minister Benjamin Netanyahu, announced by the ICC’s Chief Prosecutor, Karim Khan. According to Israeli Foreign Ministry spokesperson Oren Marmorstein on the X platform, Israel filed its official challenge against the ICC’s judicial jurisdiction and the legitimacy of the prosecutor’s request to issue arrest warrants for Netanyahu and Defense Minister Yoav Gallant. Marmorstein noted yesterday that Khan failed to allow Israel the opportunity to investigate the allegations itself before proceeding with the warrant requests.

In May, Khan requested the ICC to issue arrest warrants for Netanyahu and Gallant on suspicions of committing war crimes and crimes against humanity in Gaza. Khan also sought arrest warrants against top Hamas leaders Yahya Sinwar, Ismail Haniyeh, and Mohammed Deif for similar charges. However, the request to issue a warrant against Haniyeh was canceled on August 2nd due to his assassination in Tehran on July 31st, as stated in an ICC statement this month. The court is still considering Khan’s requests for the warrants against Netanyahu and Gallant. In August, Khan’s office urged the court to act urgently to the fullest extent, emphasizing that the court holds established legal jurisdiction in this case.

The charges against Netanyahu and Gallant include starvation of civilians, genocide, and deliberately targeting civilian populations. Unlike the International Court of Justice, which deals with disputes between states, the ICC prosecutes individuals suspected of committing the gravest crimes.
