In a striking move, the US Department of Commerce announced late Wednesday that the prominent e-commerce company eBay sold and distributed hundreds of thousands of products in violation of environmental regulations.
The Department has filed a lawsuit on behalf of the US Environmental Protection Agency (EPA) against eBay in the federal court in Brooklyn, New York. The litigation demands the court to classify eBay’s practices as an e-retailer as breaching environmental laws. Moreover, the legal move seeks to prohibit the company from persistently violating these laws and impose civil penalties for violating the Clean Air Act in the US.
Responding to the Justice Department’s lawsuit, eBay stated that the US government’s actions are “entirely unprecedented”, emphasizing their intention to vigorously defend themselves. Further, the company noted that it had banned and deleted more than 99.9% of the products the Justice Department alleged it sold and distributed, which includes millions of listings annually.
eBay highlighted its close collaboration with law enforcement agencies, including the Justice Department, for over two decades, identifying emerging threats and assisting in preventing and addressing them.
In contrast, the US Justice Department claims that “eBay sold, offered for sale, or caused the sale of more than 343,000 devices that violate aftermarket specifications and are used to deceive car exhaust emission rules, constituting a violation of the Clean Air Act.” Additionally, the Department alleges that the company violated the “Federal Insecticide, Fungicide, and Rodenticide Act” by distributing or selling at least 23,000 unregistered, counterfeit, or restricted-use products. This violation follows a sales prohibition order issued to the company by the EPA in 2020 and amended in 2021.
The move to hold e-commerce giants accountable for products that breach environmental standards or other regulations is not new but has become more pronounced in recent years. This action against eBay underscores the increasing scrutiny e-commerce platforms are under, ensuring that they not only provide a space for buying and selling but also ensure that the products meet all legal and environmental standards.
