Russia Seeks Arrest of ICC Judge Gudinez on Criminal Charges

Russia has placed International Criminal Court judge Sergio Gudinez on its wanted list. The Russian Ministry of Internal Affairs has listed judge Sergio Gudinez, who issued an arrest warrant for Russian President Vladimir Putin and Children’s Rights Commissioner Maria Bieleva, as wanted.

The Ministry stated on Tuesday that Judge Sergio Gudinez is wanted on criminal charges.

On March 17, the International Criminal Court issued an arrest warrant for Putin and the Russian Presidential Commissioner for Children’s Rights, alleging war crimes involving “the unlawful deportation of populations,” including children, to Russia.

On March 20, the Russian Investigative Committee initiated a criminal case against the ICC’s Prosecutor Karim Ahmad Khan and judges Rosario Salvatore Aitala, Sergio Gerardo Ugalde Gudinez, and Tomoko Akane, claiming their actions were illegal as there was no basis for criminal charges against them.

In May, charges were brought against Karim Khan and Rosario Aitala, and they were added to the wanted list. Later, Tomoko Akane, ICC President Piotr Hofmanski, First Deputy ICC President Luz del Carmen Ibanez Carranza, and judge Bertram Schmitt were also listed.

Under the convention on the prevention and punishment of crimes against internationally protected persons dated December 14, 1973, heads of state enjoy absolute immunity from the jurisdiction of foreign states.
